GENERAL SALES CONDITIONS OF TRAVEL EUROPE

When booking a program with Travel Europe it is assumed that the following general sales conditions have been accepted:

1. Prices
All prices are indicated in Euro. They are per person net (except where mentioned otherwise) on the basis of a double room and include all services mentioned. If drinks are included, it means one standard glass of wine / beer / juice or mineral water according to local serving volumes (except where mentioned otherwise), per person per meal. In order to guarantee the prices a minimum number of full paying passengers is obligatory (according to price table). The prices are valid until 31.03.2024 for all winter programs 2023/24, from 01.04.2024 – 31.10.2024 for all summer programs 2024, from 01.11.2024 – 31.03.2025 for all winter programs 2024/25 and from 01.04.2025 – 31.10.2025 for all summer programs 2025.

1.1 Additional charges
Some of the hotels charge additional fees during certain holiday periods, international congresses or major events (approx. 10 - 30 % of the total price in addition to the original price). For stays during these periods (e.g. Formula One grand prix or European Football Championship) or on important congresses, Travel Europe reserves the right to modify its prices and/or booking conditions.
Short stays and overnight stops: supplements may apply for short stays up to 3 nights, which will be added to clients’ travel costs. To guarantee certain complimentary services offered by the hotels (e.g. - dancing evenings with live music) a minimum stay of 4 nights is necessary.

1.2 Hotel categories
The hotel categories correspond to the official categories of the respective country. Some services related to a hotel category in a given country may therefore not correspond to the services offered by a hotel of the same category in the country of residence. Travel Europe reserves the right to indicate their own hotel rating if necessary. Not all activities ascribed to the hotel are guaranteed to be available at the time of travel. Hotel facilities, such as the restaurant, bar, pool, night club among others, may be closed or have variable opening hours, depending on the season. Such operational decisions are at the discretion of the hotel in question, according to weather conditions, safety requirements or occupancy rates. Therefore, no refunds can be granted by Travel Europe for this reason. 

1.3 Group Concessions
According to the program, Travel Europe can grant 1 group concession in a single room for every 20 full paying guests. No group concession can be granted for flights and flight programs (except where mentioned otherwise).

1.4 Child Reductions
Children pay a reduced price for the accommodation when sharing a room with two full paying adults. No child reduction will be given for other services. The following reductions apply - except where mentioned otherwise (like for example hotel accommodation in Croatia):
0 – 1,99 years 100% reduction
2 – 5,99 years 50% reduction
6 – 11,99 years 25% reduction
To receive a child reduction, the date of birth of each child has to be mentioned on every rooming list.

1.5 Excursion Package Tyrol
The excursion package in Tyrol can only be booked in combination with a hotel reservation. The Client is free to arrange the timings of the individual excursions in the package, but Travel Europe is also bound by availability and hours of business of our service providers with regards to the time and the day of visits.
Validity of the excursion package 2024: 01.04.2024 – 31.10.2024
Please consider that program changes may arise from the dates and hours of business of our services providers. Travel Europe employees will do their best to satisfy your wishes and demands.

1.6 Prices for concert tickets
In order to guarantee tickets for big musical events, Travel Europe may have to buy tickets in sales offices. Prices may therefore be superior to the tickets’ face value.

1.7 Catering
Travel Europe will arrange special menu sequences with all partner hotels and restaurants for the catering of the travel groups. Any food intolerances, allergies, special menu requests or medical treatments of individual participants having an influence on the diet must be communicated to Travel Europe at the time of booking or, at the latest, when the rooming list is submitted. Travel Europe will forward these details to all hotels and restaurants involved. Any costs incurred for special meals must be paid by the participant on site.

1.8 Variations at the exchange rate
Prices of all tour programs operated until 31st October 2024 are based on the exchange rates valid on 01.03.2023. Prices of all tour programs operated from 1st November 2024 are based on the exchange rates valid on 01.03.2024. Travel Europe reserves the right to modify the selling price as a result of a change of the exchange rate. These modifications and their consequences on the selling price will be communicated to the Client 30 days prior departure at the latest. If Travel Europe receives no reply from the Client within 8 days after the receipt of this information, the price increase is deemed to be accepted.

1.9 Change of fees, taxes and entrance tickets prices
Fees and taxes related to the services offered, such as airport fees, carbon and security tax, boarding or landing taxes in ports and airports: Travel Europe reserves the right to increase the agreed price in case of an increase of the fees and taxes mentioned above. Any price increase decreed by the State (e.g., VAT increase) will be passed on in line with the increase. In case of a significant and unpredictable increase of entrance ticket prices of other services (e.g. Plitvice Lakes National Park in Croatia), Travel Europe also reserves the right to charge the Client the amount of this price increase.

1.10 Complaints
If, for any reason, either after departure or on site, a customer decides to forego any service included in the package, they renounce the right to any refund or compensation from Travel Europe for said service. 
Any and all complaints regarding services booked through Travel Europe must be addressed to the company as soon as possible and received by Travel Europe within 4 weeks after the end of the tour. All possible evidence (attestations from the guide or service provider, photographs etc.) must be submitted alongside any request for compensation. Failure to comply with this deadline may affect the processing of the complaint.


2. Rooms

2.1 Single bedrooms
The request for single rooms can only be fulfilled if the hotel has the availability, which is limited. Although there are price supplements for single bedrooms, these rooms may be smaller than double bedrooms and do not have the same furnishing. A maximum of 10% of all registered persons per group can be booked in a single room. Above 10%, there is the possibility to book a double room for single use which means that the single room supplement has to be multiplied by 2.

2.2 Twin Rooms
Upon request, the hotels offered by Travel Europe will provide twin-bedded rooms. Nevertheless, please consider that many hotels only have a very small number of twin rooms available and therefore the accommodation in the mentioned room cannot be guaranteed by Travel Europe. In this case, clients will instead receive a double bed with 2 separated mattresses and their own bedcover. In such cases, no demands of compensation can be made for matters attributed to this kind of accommodation. If double beds with 2 separated mattresses and their own bedcover are not available, guests can be accommodated in 2 separate rooms for an additional charge.

2.3 Special room requests

Special room requests such as disabled-accessible rooms, rooms with balcony, rooms with sea view, rooms with shower etc. must be communicated to Travel Europe at the time of booking or at the latest when the room list is submitted. Travel Europe will book these rooms depending on availability in the hotels. The availability of disabled-accessible rooms is generally limited in the hotels and must be expressly requested separately. Any additional costs applicable to special room requests (with the exception of disabled-accessible rooms) will be charged to the customer.


3. Specific conditions for packages including flight(s)

3.1 Specific conditions for groups
The Client has the possibility to book groups with quota. The Client may modify or reduce the allocated quota free of charge up to 62 days prior to departure, unless other conditions have been agreed. The booking status will also have to be forwarded immediately to Travel Europe. 

3.1.1 A deposit of 20% of the dossier’s total amount should be made at the time of booking. In the case of a total cancellation of the dossier, this deposit will be non-refundable.

An updated sales status should be forwarded to Travel Europe every two weeks from the group’s reservation. The rooming list (of +/- 10%) should be communicated to Travel Europe 45 days prior the group’s arrival at the latest. Any sales status or rooming list forwarded to Travel Europe will be considered as a final reservation.

3.1.2 Cancellation
• If the cancellation is made up to 62 days prior departure: the deposit of 20% remains non-refundable.
• If the cancellation is made between 61 and 35 days before departure:
- Total cancellation: the 20% deposit remains non-refundable and cancellation fees of €85 per person apply for every final reservation.
- Partial cancellation: cancellation fees of €85 per person for every final reservation (for max. 20% of the seats initially booked) or cancellation fees of €170 per person for every final reservation apply (for any cancellation of more than 30% of the seats initially booked).
• If the cancellation is made between 34 and 14 days before departure: 50 % of the total package price.
• If the cancellation is made less than 14 days before departure: 100 % of the total package price.

3.2 Specific conditions for guaranteed departures
Upon request, Travel Europe can grant a non-binding option for no extra costs. This option can be maintained as long as the booking situation allows it, subject to commitment and availability. If this situation requires it, Travel Europe can request the Client to confirm their commitment by a final reservation or accept the cancellation of the option.

3.2.1 The Client commits to providing Travel Europe with their bookings requests as soon as possible and continuously upon reception. Subject to the capacities and availability, Travel Europe reserves the right to accept these requests, which will thus become effective bookings, or refuse them. No deposit nor dossier fees will be requested. Nevertheless, the Client will have to pay an extra fee for guaranteed departures corresponding to 8% (4% for hotel stays) of the dossier’s amount (to be added to the total dossier’s amount).

3.2.2 Cancellation of a final reservation
Any sales status or rooming list forwarded to Travel Europe will be considered as a final reservation. In the case of a cancellation of a reservation having been confirmed and therefore considered as final, cancellation fees will apply:
• If the cancellation is made between 34 and 14 days before departure: 50 % of the total package price
• If the cancellation is made less than 14 days before departure: 100 % of the total package price

3.3 Transfers
In cases where the flights are booked by the Client themselves, any airport – hotel – airport will be charged to the Client.

3.4 Prices charter programs 

from 1 April 2023 until 31 October 2025
The prices are established according to the following rates: 
• BRENT oil price at USD 80,00 per barrel 
• EUR 1,00 = USD 1,15

Madeira, Israel and Jordan:
Rates: USD 80,00 / barrel and EUR 1,00 = USD 1,15
Oil price: The prices are guaranteed until a maximum price of USD 80,00 per barrel of crude oil. In case of a crude oil price increase, Travel Europe will charge a supplement of EUR 1,05 per person and per USD 1,00 of crude oil price increase beyond USD 80,00. This supplement may be increased beyond the rates indicated above. Example: The oil barrel price amounting to USD 90,00 would imply a supplement of EUR 10,50 per person. If the rate is below USD 80,00 per barrel, Travel Europe will not apply any reduction.
Exchange rates: The prices are guaranteed until an exchange rate of USD 1,15 = EUR 1,00. If the dollar exchange rate against the euro drops below the threshold of USD 1,15 = EUR 1,00, Travel Europe will charge a supplement of EUR 0,63 per USD 0,01. Example: The dollar exchange rate against the euro dropping to USD 1,05 = EUR 1,00, Travel Europe will charge EUR 6,30 per person. If the dollar exchange rate against the euro exceeds the threshold of USD 1,15 = EUR 1,00, Travel Europe will not apply any reduction. 

Other destinations:
Rates: USD 80,00 / barrel and EUR 1,00 = USD 1,15 
Oil price: Prices are guaranteed until a maximum price of USD 80,00 per barrel of crude oil. In case of a crude oil price increase, Travel Europe will charge a supplement of EUR 0,75 per person and per USD 1,00 of crude oil price increase beyond USD 80,00. This supplement may be increased beyond the rates indicated above. Example : The oil barrel price amounting to USD 90,00 would imply a supplement of EUR 7,50 per person. If the rate is below USD 80,00 per barrel, Travel Europe will not apply any reduction.
Exchange rates: The prices are guaranteed until an exchange rate of USD 1,15 = EUR 1,00. If the dollar exchange rate against the euro drops below the threshold of USD 1,15 = EUR 1,00, Travel Europe will charge a supplement of EUR 0,45 per USD 0,01. Example: The dollar exchange rate against the euro dropping to USD 1,05 = EUR 1,00, Travel Europe will charge EUR 4,50 per person. If the dollar exchange rate against the euro exceeds the threshold of USD 1,15 = EUR 1,00, Travel Europe will not apply any reduction.

ETS tax:
In addition, the ETS tax is included in the package price. For charter flights, this tax is calculated on the basis of the value applied in March 2024, equal to 59.67 EUR. This value is updated 1 month before departure. In the event of an increase, Travel Europe reserves the right to invoice the customer accordingly.

3.5 Specific conditions for bookings on scheduled flights
Depending on the airline and the volume of passengers, Travel Europe reserves the right to apply special conditions. If the modification of one or several passengers’ names implies extra costs, these will be charged to the Client. The days of operation are defined according to the airlines current and estimated flight plans. Travel Europe’s offer is dependent on the actual final flight plan. Should an airline, for any reason, change its days of operation, flight route or cancel a flight, Travel Europe will immediately pass on the information to any affected clients. In such an eventuality, Travel Europe cannot be held responsible. However Travel Europe will endeavour to find a solution consistent with the new flight plan. When such a situation occurs and is internal to the airline, claims of compensation against Travel Europe will not be recognized.

3.6 Cancellation of the tour due to lack of participants
Travel Europe may terminate this contract by refunding all deposits paid by the Client, but without compensation, in cases where (and no later than 60 days prior to departure) the number of passengers booked on flights from local airports does not reach a minimum of 100 persons, or if the total number of people on the coach tour does not reach the minimum of 20 persons.

3.7 Strikes, unpredictable events
In the event of strikes, any other unpredictable event or events that cannot be influenced by Travel Europe, Travel Europe will try their best to provide the services booked (e.g. Travel Europe tries to transfer clients to another airport). Such incidents cannot be mentioned as a reason for the cancellation of a journey by the Client. Under no circumstances will Travel Europe be responsible for any caused damage.

3.8 Regulations or norms issued by official authorities
In the event of a regulation or norm issued by official authorities that would complicate considerably the entry to a territory (e.g. travel warnings) or increase significantly the price of the journey (e.g.: case where every second seat should be occupied in the coach), Travel Europe reserves the right to cancel the trip. The Client also has the right to proceed to a cancellation free of charge. Travel Europe will try their best to find an alternative solution, which, however, cannot be guaranteed and is not considered eligible. In the event of a cancellation due to the circumstances mentioned above, the Client will be refunded for the amounts already paid.

3.9 Guaranteed departures
The departures are guaranteed (except if no mention), however the modification of an airport of departure can be justified under exceptional circumstances. In this case, Travel Europe organizes the transfer to the new airport. This does not result in any compensation or cancellation.

3.10 Flight schedules and departure airports
The first and last days are considered to be dedicated to outward and return travel. Tour prices are calculated according to the duration and content of the program sold and not based on a number of full days. The day of departure (meeting time) and the day of return (time of arrival) are included in the duration of the trip. The first and last nights may be shortened due to a late or early arrival or departure times according to air travel constraints. In this case no refunds can be validated. 

In the event of a late arrival at the hotel on the first day, some hotels may no longer serve a hot dinner. In this case, a cold meal will be counted as the first dinner scheduled in the program, and no refund will be offered by Travel Europe. The conditions for chartered seats, special planes, seat blocks oblige Travel Europe to specify that any seat unused on the outward or return trip cannot be refunded, even in the event of a date change. Travel Europe is dependent on the fluctuating schedules of airlines which may change at any time. The flight times indicated are not a contractual element and neither Travel Europe nor the airlines can be held responsible. In the case of damage, complaints or claims the liability of the airlines is exclusively limited to the air transport of passengers and their luggage as specified in their conditions of carriage. The contract establishes the obligation of the airline to transport passengers from the city of departure to the city of arrival, without guaranteeing times, stopovers, connections, type of aircraft or airports used. In the event that the departure and / or return airport cannot be used for any reason, the organizer will pay for the transfer by land to the substitute airport without any other services or damages of any kind. Travel participants are advised not to make any commitments on the day of return or the day after, given the possibility of delays. Likewise, in the event of a breakdown or technical incident of the air carrier requiring accommodation near the airport, paid for by the carrier, and which may therefore shorten the duration of the trip, the Client may not claim any refund or damages.

If several flights depart from the same airport on the same day, Travel Europe will, of course, try their best to offer the same aircraft for matching passengers, but Travel Europe cannot guarantee this. Upon an additional charge of 10 % of the flight costs, Travel Europe guarantees that the entire group will be transported in the same aircraft. The same applies if guaranteed flight times are requested. If a city has more than one airport, the departure airport will be confirmed at the time of notification of flight times at the latest.

3.11 Luggage 
Any claim regarding loss of or damage to luggage, related to air or land transport, must be communicated to Travel Europe or its representatives immediately. The "baggage claim tag" (provided by the airline at check-in) and a copy of the plane ticket must be presented. Late complaints after returning from the trip cannot, under any circumstances, be accepted. The total weight of luggage is limited to 15 kg per passenger (unless otherwise indicated). 
 

4. Specific conditions for packages without transportation (hotels, stays and circuits)

4.1 Prices
Travel Europe underlines the fact that highway expenses and tolls are not included in the cases where land transportation is not included in the journey’s price, i.e. when the Client organizes the land transportation themselves.

4.2 Sales status
An updated sales status should be forwarded to Travel Europe every two weeks from the group’s reservation. The rooming list (of +/- 10%) should be communicated to Travel Europe 45 days prior the group’s arrival at the latest. From 20 persons booked, Travel Europe considers that the trip will take place.

4.3 Cancellation fees
In the event of a confirmed reservation, the places constitute a binding agreement and the Client accepts the following cancellation fees:

4.3.1 In the case of a cancellation of individual pre-booked places 
• In case of a cancellation made more than 30 days before departure, no cancellation fees are applied, except for New Year’s Eve programs, all services in Germany and Switzerland and for special agreements.
• If the cancellation is made 29 to 15 days before departure: 25% of the total package price
• If the cancellation is made 14 to 8 days before departure: 50% of the total package price
• If the cancellation is made 7 to 2 days before departure: 75% of the total package price
• If the cancellation is made 1 day before departure, the day of departure itself or in case of “No show”: 100% of the     total package price

4.3.2 In the case of a cancellation of a whole group, the following fees apply:
• If the cancellation is made more than 30 days before departure of a group for which a booking status of 20 persons or
    more has already been sent: 25% of the total package price
• If the cancellation is made more than 30 days before departure, for a group for which Travel Europe has not yet received     any rooming list or if the booking status is 19 persons or less: Travel Europe reserves the right to pass on the possible     costs incurred.
• If the cancellation is made 29 to 15 days before departure: 25 % of the total package price
• If the cancellation is made 14 to 4 days before departure: 65 % of the total package price
• If the cancellation is made less than 3 days before departure: 80 % of the total package price
• If the cancellation is made 1 day prior before departure, the day of departure itself or in case of “No show”: 100% of     the package price

For certain particular events, e.g. New Year’s Eve, Travel Europe reserves the right to ask the Client for a deposit, which will not be refundable in case of group’s cancellation. Furthermore, Travel Europe reserves the right to set deadlines and/or more important cancellation fees for some events and specific periods.

4.4 Strikes, unpredictable events
In the event of strikes, any other unpredictable event or events that cannot be influenced by Travel Europe, Travel Europe will try their best to provide the services booked. Such incidents cannot be mentioned as a reason for the cancellation of a journey by the Client. Under no circumstances will Travel Europe be responsible for any caused damage.

4.5 Regulations or norms issued by official authorities
In the event of a regulation or norm issued by official authorities that would complicate considerably the entry to a territory (e.g. travel warnings) or increase significantly the price of the journey (e.g.: case where every second seat should be occupied in the coach), Travel Europe reserves the right to cancel the trip. The Client also has the right to proceed to a cancellation free of charge. Travel Europe will try their best to find an alternative solution, which, however, cannot be guaranteed and is not considered eligible. In the event of a cancellation due to the circumstances mentioned above, the Client will be refunded for the amounts already paid.


5. Payment
All bank transfers have to be made net without any further charges in the favor of Travel Europe. In the case where a previous trip would not have been paid in full yet, every payment is credited towards the oldest debt on Travel Europe’s client´s account.

5.1 For the B2B Client
The total cost of the trip must be paid by bank transfer, whereby the amount due is credited to Travel Europe’s accounts a minimum of 14 days before the group’s departure date.

Specific conditions for B2B reservations with flight(s):
• In according to article 3.1: A deposit of 20% of the dossier’s total amount shall be transferred at the time of reservation. The rest of the sum shall be paid 30 days before departure.
• In according to article 3.2: The dossier’s amount shall be paid 14 days before departure.

Non-compliance with the payment conditions by the Client:
It is expressly agreed that these conditions are binding on Travel Europe only under the condition that full payment is made by the Client by the due date. In the absence of full payment by the Client under the conditions set out above, Travel Europe may no longer guarantee: 
- the agreed price, and reserves the right to make any adjustments necessary to operate the tour concerned, at the risk of a change in quality of the services provided. Since, in this case, payment conditions have not been met, there will be no possible recourse for the Client. 
- the execution of the tour: if the Client does not comply with Travel Europe's payment conditions, Travel Europe reserves the right to cancel any services already reserved and invoice any costs incurred.

5.2 For the B2C Client
A deposit of 20% of the trip’s total amount is to be paid immediately after reservation. The rest of the sum is due 20 days before departure at the latest. The Client’s funds are fully secured in accordance with an accountability statement by the Austrian Hotel and Tourism Bank (Österreichische Hotel- und Tourismusbank GmbH). Claims should be forwarded to the liquidator TVA-Tourismusversicherungsagentur GmbH, Baumannstr.9, A-1030 Vienna, telephone: +43 1 361 90 77-0.


6. Changes

6.1 Services included in a program
The dates of the different excursions and night shows can be modified without altering the program’s services. Travel Europe also informs the Client that some changes, even of small importance, can occur in the services’ operation. All services confirmed by Travel Europe will be provided. Furthermore, if a program cannot be carried out because of bad weather or major incidents, Travel Europe will arrange another program, where possible.

6.2 Optional services
Some of the optional services offered by Travel Europe may require a minimum number of participants (depending on the service). If this number is not achieved, Travel Europe has the right to cancel the service at short notice.

6.3 Distances (in kilometres) are only approximate indications.


7. Administrative formalities
The Client is responsible for travelling persons’ compliance with all legal and administrative requirements regardless of nationality. Travel Europe remains at your entire disposal for any additional information required concerning the destination countries. The price of the tour / stay will not be refunded, under any circumstances, in the event of a missed departure due to non-compliance with the administrative regulations or failure to provide the required documents such as passport, visa or medical certificates. Travel Europe will not be responsible for any costs arising from failure to comply with the legal and administrative requirements in place. In the event that a participant is refused entry, for any reason whatsoever, into the territory of one of the countries visited while travelling with Travel Europe, the repatriation costs (for example: plane tickets) must be paid by the participant. Any expenses incurred by Travel Europe must be refunded by the Client upon presentation of the invoice.

8. Legal basis
Any differences, which cannot be solved by mutual agreement, will exclusively be brought before the responsible court in Innsbruck. Legal basis is the Austrian law.

9. Responsibility of Travel Europe
The responsibility of Travel Europe cannot replace that of the service providers, although Travel Europe is responsible for their selection. In the event that one of the providers experiences a failure in the operation of the service, Travel Europe will do everything in its power to help the Client assert his rights for any justified claim. Travel Europe cannot be held responsible for the non-operation or improper operation of the service if the cause is attributable:
- either to the Client;    
- either to the unforeseeable fact of a third party who is not involved in the provision of the services included in the contract;
- or to a case of force majeure, in particular strike of means of transport, hotel staff, air traffic controllers, war, insurrection, riot or any prohibition decreed by government or public authorities.
The consequences of accidents or incidents that may occur during the operation of air or land transport are governed by the provisions of the Warsaw Convention or local regulations governing national transport in the country concerned.

10. Errors
Travel Europe does not assume any liability for printing or typing errors, or errors in terms of content.

11. Directory of tour operators
Travel Europe Reiseveranstaltungs GmbH is officially registered as a tour operator by the Austrian authorities. More details can be found at:
